Terms of Service

By downloading, accessing, or using the Eras mobile application (“App”) or visiting our website at eras.market (“Website”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App or Website.

Eras reserves the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

You must be at least 18 years old to use Eras. By creating an account, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.

To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Usernames must be 3-24 characters long and may contain letters, numbers, and underscores. Eras reserves the right to remove or reclaim usernames that violate these Terms or are inactive for extended periods.

Eras is a peer-to-peer marketplace for vintage, collectible, and nostalgic items. By listing items, you represent that:

• You have the legal right to sell the item
• The item description and photos are accurate and not misleading
• The item does not violate any laws or regulations
• The item is not counterfeit, stolen, or prohibited

Eras does not take possession of, inspect, or verify any items listed on the platform. All transactions are between buyers and sellers directly. Eras is not a party to any transaction and is not responsible for the quality, safety, legality, or delivery of any item.

You may not list items that are:

• Illegal to sell in your jurisdiction
• Counterfeit, replica, or knock-off goods
• Stolen property
• Weapons, ammunition, or explosives
• Drugs, drug paraphernalia, or controlled substances
• Tobacco products, e-cigarettes, vaping devices, or related paraphernalia (vintage tobacco-branded memorabilia such as advertising signs or unfilled lighters is permitted)
• Hazardous materials
• Items that infringe on intellectual property rights
• Pornographic, sexually explicit, or adult content of any kind, including but not limited to:
  • Vintage adult magazines such as Playboy, Penthouse, Hustler, Oui, and any similar publications
  • Adult films or videos in any format (VHS, Betamax, DVD, etc.)
  • Photographs, prints, posters, calendars, or trading cards depicting nudity or sexual activity
  • Items whose primary purpose is sexual
• Items targeted at or designed primarily for minors that contain mature themes
• Living or dead animals, animal parts, or items made from endangered species
• Human remains or body parts
• Government-issued identification, currency, or official documents

Mature themes are permitted in vintage media so long as no nudity or sexually explicit content appears in the listing photos or description. Eras reserves the right to remove any listing at our sole discretion, including listings that comply with the letter of this section but, in our judgment, are inconsistent with a general-audience marketplace. Repeat violations may result in account suspension or termination.

Buyers may submit offers on listings. Sellers may accept, decline, or counter any offer. An accepted offer creates a binding agreement between the buyer and seller to complete the transaction at the agreed price.

Offers expire after 48 hours if not responded to. Eras is not responsible for enforcing completed transactions or resolving disputes between buyers and sellers, though we may assist at our discretion.

Listing items on Eras is free. Eras offers optional in-app purchases to promote listings:

• Bump — Push your listing to the top of the feed ($1.99)
• Promote — Feature your listing with a badge for 1-7 days ($2.99-$9.99)

These are consumable purchases processed through Apple App Store or Google Play Store. All purchases are final and non-refundable, except as required by applicable law or the respective app store's refund policies.

You retain ownership of content you post on Eras, including photos, descriptions, and memories. By posting content, you grant Eras a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating the App and Website.

You are solely responsible for the content you post. Content must not be defamatory, harassing, threatening, obscene, or otherwise objectionable. Eras reserves the right to remove any content that violates these Terms.

After a completed transaction, both buyers and sellers may leave reviews. Reviews must be honest, accurate, and based on the actual transaction experience. Eras reserves the right to remove reviews that are fraudulent, abusive, or violate these Terms.

You may delete your account at any time through the App settings. Upon deletion, your personal data will be removed, your listings will be taken down, and your account will be permanently deactivated.

Eras may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or pose a risk to other users. Banned users may not create new accounts.

To the maximum extent permitted by law, Eras shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Eras's total liability shall not exceed the amount you paid to Eras in the 12 months preceding the claim.

Eras is provided “as is” without warranties of any kind, express or implied. We do not guarantee uninterrupted service, accuracy of listings, or the conduct of other users.

You agree to indemnify and hold harmless Eras, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, your content, or your violation of these Terms.

These Terms are governed by the laws of the United States. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
